Kemble Retains Flying Activities After Ruling

Mr Justice King in the High Court has upheld the decision made by Members of Cotswold District Council’s Planning (Regulatory) Committee on June 25th 2008.

This ruling, which was heard in London on Tuesday June 23rd, means that the Certificate of Lawfulness of Existing Use or Development – or CLEUD – issued by the Council in July 2008 stands and Kemble Airfield can be used for general aviation purposes.

A CLEUD is sought when a person wishes to confirm that any existing use already taking place on a site is lawful.

The term ‘general aviation purposes’ embraces all flying activities other than cargo/freight flying, and passenger flights – if passenger flights departed from Kemble Airfield, then this would not be within the Lawful Use.

Wiltshire Council did ask for leave to appeal the decision but this was refused. However, they still have the opportunity to re-apply to the Court of Appeal.

Councillor John Birch, Cotswold District Council’s Portfolio Holder for Planning, said: “The Council recognises that a lot of local people will be disappointed by this decision.

“However, the decision originally made by the Council’s Planning (Regulatory) Committee was a correct one and this has been confirmed by Mr Justice King in the High Court.”
