Cotswold DC defers Kemble enforcement notice

The operators of Kemble airfield have been given more time by Cotswold District Council to ensure general flying activities are regulated.
The Council’s Planning (Regulatory) Committee today (January 9) agreed to defer re-issuing an enforcement notice against unauthorised flying activities at the site. The operators have been given three months to submit evidence for a Certificate of Lawful Use or Existing Development (CLUED) or a planning application.
The Committee’s decision comes after a planning inquiry into the case was closed by the Planning Inspector in November after the Council withdrew its enforcement notice to avoid the risk of it being quashed on a technicality without other planning issues being considered.
The Inspector felt that the notice should have listed all the activities at the airfield to which the Council had no objection, as well as those it wished to take enforcement action against.
The Council maintains that the principal established planning use of the airfield is for storage, repair and maintenance, and that flying activities should only be ancillary and incidental to those operations. Committee Chairman Cllr Sue Jepson said after today’s meeting: “Since November, the airfield operators have informed the Council that they are willing to make an application for a CLUED and the Committee was encouraged by this news
“On that basis, the Committee today agreed that it would defer re-issuing the enforcement notice for three months to give the operators a further opportunity to submit the additional evidence we believe is required for a CLUED or to make a planning application. “It is clearly the case that the Council does not wish flying activities at the airfield to stop altogether – there are economic, social and heritage benefits in Kemble’s continued use as an airfield. However, the current level of activity is causing disturbance to some local residents and that is likely to continue without controls in place. “We have a duty of care to our community to ensure the airfield is subject to appropriate planning regulations and have given the operators further time in order that we can bring this matter to a resolution.”
